ATA products require an Export
License from the U.S. Department of State or the U.S. Department of
Commerce before these products can be
exported. This applies to both stand-alone units, or any assembly or
finished goods that contain the product irrespective of their intended
use. See section 123.9 (b) of the ITAR regulations, specific export
license under the ITAR (International Traffic in Arms) regulations. Other
ATA products may be exported without specific export license required when
shipping to destinations other than those identified in Country Group E of
supplement 1 to Part 740 of the Export Administration Regulations (EAR),
or if the exporter knows or is informed that the items will not be used in
prohibited chemical, biological or nuclear weapons or missile activities
defined in Part 744 of the EAR. ATA Products delivered to international
customers may be returned to ATA for repair and recalibration for return
to the original customer without reapplying for an export license.

The commodity
jurisdiction classification for these sensors is ITAR Category XII,
Section (d), Inertial platforms and sensors for weapons or weapon systems;
guidance, control and stabilization systems.
ATA will submit U.S. Department of State or U.S. Department
of Commerce license requests on
behalf of our customers. For all international sales orders for the above
products, the customer is required to submit a form DSP-83 available from
the link below with Sections 7 or 8 completed and signed. In addition,
the customer must submit a letter written on company (or government)
letterhead stating the end-use of the product, and the name and address of
the individual / group that will possess the product. In the case of
government defense programs, the name of the program or code name should
be included. Customer shall also identify the customs agent to receive the
goods in the country of final destination in a format that includes the
name of company, street address, city and country, telephone, etc.

We include the identification (name and complete address)
of the USA freight forwarder, the foreign intermediate consignee, the name
and address of the foreign consignee (usually our distributor) and the end
user name and address on the license application and these cannot
change after the license application is filed. Changes after
submission require a new license application and incur added time and charges.
Upon receipt of the
above information along with valid purchase order, ATA will prepare and
submit the necessary export license requests and copies to the U.S.
Department of State or U.S. Department of Commerce. The entire licensing process takes 8 to 10 weeks
before the export license is issued and returned to ATA. We will
manufacture the sensors concurrent with the licensing process and
generally ship within 48 hours of receiving the approved export license.
All shipments of licensed goods will be
made by Federal Express Air Parcel Service to your designated agent at the
receiving international airport. These are airport to airport shipments
ONLY. Other air parcel companies may be specified at time of order but
these are subject to approval and confirmation that they are able and
willing to accept a licensed export shipment and file
the necessary paperwork with customs and return completed export license
forms back to the U.S. Department of State or U.S. Department of Commerce.
